UHMC Title IX – Sex Discrimination and Gender-Based Violence Information and Procedures

Each member of the campus community is responsible for preventing sexual misconduct and ensuring that the work and academic environments are harassment-free.

The University of Hawai’i Maui College (UHMC) strives to provide all a safe and respectful learning and working environment that emphasizes the dignity and worth of every member of its community and is free from harassment, discrimination, and violence. Such an environment is necessary to a healthy learning, working, and living atmosphere because discrimination and harassment undermine human dignity and the positive connection among all members in our UHMC community.

UH Maui College is committed to a policy of nondiscrimination on the basis of race, sex, gender, sexual orientation, age, religion, color, national origin, ancestry, disability, domestic violence, marital status, arrest and court record, and veteran status. Examples of prohibited behavior include, but is not limited to:

  • Sexual harassment;
  • Gender-based harassment, including harassment based on actual or perceived sex, gender, sexual orientation, gender identity, or gender expression;
  • Sexual exploitation;
  • Sexual assault;
  • Domestic violence;
  • Dating violence;
  • Stalking; and
  • Discrimination based on race, victims of domestic or sexual violence, age, religion, color, national origin, ancestry, citizenship, disability, genetic information, marital status, breastfeeding, income assignment for child support, arrest and court record (except as permissible under State law), national guard absence, or status as a covered veteran).

The grievance policy and procedure that UHMC will use to address any allegations of sex discrimination and gender-based violence involving students, employees and/or visitors or third parties at UHMC will be the UH System’s Executive Policy EP 1.204 – Policy and Procedure on Sex Discrimination and Gender-Based Violence .

What Options Do I Have?

If you wish to report an incident of sex discrimination or gender-based violence including sexual assault, sexual harassment, gender-based harassment, domestic violence, dating violence or stalking as well as receive information and support:

  • You can get resources and support anonymously
  • If you wish to remain ANONYMOUS, speak with someone CONFIDENTIALLY
  • If you would like to receive information and support that is CONFIDENTIAL, it is available for students and staff
  • You can also file a report which can’t guarantee confidentiality and will be handled by UHMC Title IX staff

Who Can File a Complaint?

A complaint of discrimination can be filed by anyone who believes that an education institution that received Federal financial assistance has discriminated against someone on the basis of race, color, national origin, sex, disability, religion, or age.

The person or organization filing the complaint need not be a victim of the alleged discrimination, but may complain on behalf of another person or group.

How Do I File A Complaint?

If you, or someone you know, has experienced or have information regarding a victim or issue regarding alleged sex discrimination, gender-based violence including sexual assault, sexual harassment, gender-based harassment, domestic violence, dating violence, stalking, or retaliation, there are several options available depending on the type of assistance you want:

  • If you want help but are not ready to make a formal report, please contact a confidential resource on UH Maui College  to explore your options and receive services.

Title IX Coordinators have the primary responsibility for sexual harassment and sexual discrimination investigations, resolutions, trainings, remediation, resolution and prevention on the basis of sex. Campus administrators, and supervisors have a duty to identify and promptly report all acts of or complaints made on sexual harassment or discrimination to the aforementioned offices.

Although filing a report with a UHMC Title IX Coordinator usually allows for a more expedient resolution in many cases, Reporters may also seek a criminal conviction by filing a report with the local police by calling 911.

What Does This Mean for UH Staff?

As a member of the University, faculty and staff are expected to immediately report any incident of sex discrimination or gender-based violence to the campus Title IX Coordinator. Although the Title IX Coordinator and staff cannot guarantee confidentiality, you will still have options about how your case will be handled.

The goal is to make everyone aware of the range of options available and have access to the resources and support needed.

UH Policies and Procedures provide guidance on compliance with the complex and interrelated requirements of sex discrimination and sexual violence laws that cover students, employees and third parties including both on-campus and off-campus situations. More specifically, it incorporates the requirements and spirit of the Title IX of the Education Amendments of 1972 and the Reauthorization of the Violence Against Women Act of 2013.

Title IX Online Training

Some of the materials covered in the training course may remind you of upsetting experiences that you, a friend, or family member may have gone through. Please know that you can stop the training at any time, and there are many University and community resources available to you for support, such as counseling, victim advocacy, and legal support.

1. PREVENTING HARASSMENT AND DISCRIMINATION COURSE

Take the Online Training Course: Preventing Harassment & Discrimination for Employees

Preventing Harassment and Discrimination course prepares faculty and staff to cultivate and maintain a workplace culture resistant to discrimination, harassment and retaliation. Faculty and staff will be equipped with the information and skills that promote intervention, empathy, and allyship. This course includes a section specific to requirements under Title IX and the Clery Act.

This training takes approximately 70 minutes.

Athletics staff, volunteers, and other non-UH users will access the training using this link: Vector Online Training Guest Site. Please contact your HR representative, campus Title IX Coordinator, or Administrator for assistance and clarification.

2. WORKPLACE NON-VIOLENCE TRAINING

Take the Online Training Course: Code of Conduct: Workplace Conduct

Learn about the scope and risks of workplace violence, the warning signs that may identify potential assailants, how to reduce the risk of injury during violent situations, and how we respond to incidents of violence. The UH Online Workplace Violence Course is essential for all employees.

This training takes approximately 30 minutes.
